Terms of Service & Binding Agreement

PLEASE READ CAREFULLY. THESE TERMS CONTAIN A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS.

1. Acceptance of Terms

By accessing, browsing, or purchasing from Speed Hookah LLC (“the Site”, “We”, “Us”), you agree to be bound by these Terms of Service, our Shipping Policy, and our Refund Policy. If you do not agree, you must immediately cease using this Site.

We operate from the State of Florida. Access to this Site is unauthorized in any jurisdiction where the sale or use of our products is prohibited by law.

2. Strict Age Restriction (21+)

YOU MUST BE 21 YEARS OF AGE OR OLDER TO PURCHASE FROM THIS SITE.

By placing an order, you certify under penalty of perjury that:

You are at least 21 years of age.
The information you provide is accurate and truthful.
You are not purchasing products on behalf of a minor (Straw Purchasing).

Age Verification Process: We use AgeChecker.net, an independent third-party age verification service, to confirm that every customer is at least 21 years of age. This automated process occurs during checkout and may require the customer to upload a government-issued photo ID for real-time validation. Orders that fail this verification will be automatically cancelled and refunded.

3. Compliance with PACT Act & Florida Statutes

Speed Hookah LLC complies fully with the Prevent All Cigarette Trafficking (PACT) Act and Florida Statute Chapter 569.

Adult Signature Required: All shipments containing tobacco or vape products legally require an Adult Signature (21+) upon delivery.
Prohibited Carriers: We do not ship vaping products via USPS. We use private regional carriers compliant with federal law.
Taxes: You are responsible for all applicable state and local sales/excise taxes. In accordance with the Jenkins Act, we report all interstate sales of regulated tobacco/vape products to the respective state tax administrators. This means your state may bill you directly for unpaid excise taxes if applicable.

4. Health Warnings & Product Liability

WARNING: Products sold on this site contain nicotine. Nicotine is an addictive chemical.

Not for Non-Smokers: Our products are intended for use by adult smokers only.
No Medical Claims: Our products are not smoking cessation devices and have not been evaluated by the Food and Drug Administration (FDA) to treat, cure, or prevent any disease.
Limitation of Liability: To the fullest extent permitted by law, Speed Hookah LLC shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use, misuse, or defect of any product purchased from us. Use all lithium-ion batteries and heating elements at your own risk.

5. Order Cancellations & Fraud Protection

We reserve the right to refuse service or cancel any order for any reason, including but not limited to:

Suspicion of credit card fraud.
Mismatch between Billing and Shipping addresses.
Failed age verification.
Orders shipping to “High Risk” locations (e.g., freight forwarders, schools, hotels).

Friendly Fraud Policy: If you file a chargeback with your credit card issuer for a valid transaction that was delivered (as confirmed by carrier tracking), Speed Hookah LLC considers this “Friendly Fraud” (theft).

We will contest the dispute with full documentation (IP address, GPS delivery data, Age Verification logs).
You agree to reimburse us for the original amount plus a $50.00 Chargeback Administrative Fee and any legal fees incurred.
Unpaid debts arising from fraudulent disputes will be sent to a third-party collections agency and reported to credit bureaus.

6. Return & Refund Policy (Summary)

By agreeing to these Terms, you acknowledge you have read our Return Policy.

ALL SALES ARE FINAL for e-liquids, disposables, and opened hardware.
Returns for “change of mind” or “flavor dislike” are strictly prohibited.
Refused deliveries or packages returned due to lack of Adult Signature are subject to a 25% Restocking Fee plus shipping costs.

7. Binding Arbitration & Class Action Waiver

DISPUTE RESOLUTION: Any dispute or claim relating in any way to your use of Speed Hookah LLC or products sold by us will be resolved by BINDING ARBITRATION, rather than in court, except that you may assert claims in small claims court if your claims qualify.

CLASS ACTION WAIVER: WE EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than in arbitration, WE EACH WAIVE ANY RIGHT TO A JURY TRIAL.

8. Governing Law

These terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located within , Florida.

9. Indemnification

You agree to indemnify, defend, and hold harmless Speed Hookah LLC, its officers, directors, employees, and suppliers from any claim, demand, or damage, including reasonable attorneys’ fees, asserted by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.
